FREELANCER TERMS OF SERVICE.

These Freelancer Terms of Service (“Agreement” or “Terms of Service”) establish a comprehensive and legally binding agreement between you, the individual freelancer (“Freelancer,” “you,” or “your”), and Earher AI, a global artificial intelligence solutions provider, including its subsidiaries, affiliates, and assigns, such as Earher QuamtumAI (OPC) Private Limited (“Earher AI,” “we,” “us,” or “our”).

By accessing, browsing, registering with, or using any services, products, platforms, or tools made available through Earher AI—including, but not limited to, our official websites (www.EarherAi.com), our AI development platform (Nebula AI at app.earherai.com), and any other services offered under the Earher AI brand—you expressly agree to be legally bound by the terms and conditions set forth in this Agreement, our Privacy Policy, and any other policies or guidelines that are referenced herein or may be published by Earher AI from time to time.

Your continued use of our Services, platforms, or any affiliated offerings shall constitute your unequivocal acceptance of and adherence to this Agreement. If, at any time, you do not agree with the Terms of Service or our Privacy Policy, you must discontinue use of our Services immediately.

IMPORTANT NOTICE: THESE TERMS INCLUDE MANDATORY BINDING ARBITRATION, A WAIVER OF JURY TRIALS, AND A CLASS ACTION WAIVER, WHICH MAY AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW THESE SECTIONS CAREFULLY.

BY AFFIRMATIVELY INDICATING YOUR ACCEPTANCE—WHETHER BY CLICKING “I ACCEPT,” REGISTERING FOR AN ACCOUNT, OR OTHERWISE ACCESSING OR USING OUR SERVICES—YOU HEREBY REPRESENT, WARRANT, AND AGREE THAT:

(A) YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO BE BOUND BY THIS AGREEMENT;
(B) YOU ARE AT LEAST 18 YEARS OF AGE OR THE AGE OF MAJORITY IN YOUR JURISDICTION;
(C) YOU POSSESS THE LEGAL CAPACITY AND AUTHORITY TO ENTER INTO THIS AGREEMENT;
(D) IF YOU ARE ACTING ON BEHALF OF A BUSINESS ENTITY OR ORGANIZATION, YOU ARE DULY AUTHORIZED TO ACCEPT THESE TERMS ON BEHALF OF SUCH ENTITY. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE OR ACCESS OUR SERVICES.

All capitalized terms not otherwise defined in this Agreement shall have the meanings ascribed to them in our Privacy Policy, which is incorporated herein by reference.
